What Personal Information Does the Company Require?
All Weather Capital (Pty) Ltd (“the Company”)’s Personal Information Protection Policy governs the Processing of your Personal Information.

- Medical history
- Financial history
- Criminal history
- Employment history
- Any:
- Identifying number
- Symbol
- Email address
- Physical address
- Telephone number
- Location information
- Online identifier
- Other particular assignment to the person
- Biometric information.
- Personal opinions, views, or preferences.
- Correspondence sent by the person that is implicitly or explicitly private or confidential, including further correspondence that would reveal the contents of the original correspondence.
- The views or opinions of another individual about the person.
- The name of the person, where it appears with other personal information relating to that person, or where disclosure of the name itself would reveal information about the person.
“Processing” is defined in POPIA as:
Any operation or activity, or any set of operations, whether or not by automatic means, concerning personal information, including:
- The collection, receipt, recording, organisation, collation, storage, updating, modification, retrieval, alteration, consultation, or use of personal information.
- Dissemination by means of transmission, distribution, or making information available in any form.
- Merging, linking, restriction, degradation, erasure, or destruction of information.
The Company is a Responsible Party in respect of the Personal Information you (the Data Subject) provide.
The Company processes the following categories of Personal Information:
- Identification document.
- Proof of residential or business operating address.
- South African Income Tax registration number.
- South African VAT registration number (where applicable).
- Contact numbers.
- Email addresses.
- Banking details.
Why Does the Company Require Your Personal Information?
The Company requires this Personal Information in terms of the Financial Intelligence Centre Act, 38 of 2001 (FICA), and the Company’s Risk Management and Compliance Programme.
The Personal Information forms part of the Company’s requirements when:
- Obtaining a discretionary mandate from you.
- Opening an account to facilitate the relevant business activities.
The Company requires your Personal Information in order to:
- Establish a legal relationship with you.
- Populate client account information required on the relevant onboarding platforms.
- Open and administer your account.
- Generate statements and maintain contact information associated with your discretionary mandate or account.
How Is Your Personal Information Processed?

Your Personal Information is also stored at the same address.
No third-party service providers have direct access to your Personal Information unless such access is:
- Required by law; or
- Necessary to satisfy client due diligence requirements.
Your Personal Information may be shared with the relevant company for account-opening purposes.
How Long Does the Company Keep Your Personal Information?
In terms of South African law, the Company is required to retain your Personal Information for a period of five (5) years following the termination of the business relationship, in accordance with the Company’s Personal Information Retention Policy.
At the end of the retention period, your Personal Information will be irreversibly destroyed.

What Are Your Rights?
If you believe that any Personal Information held by the Company is inaccurate, incomplete, or outdated, you have the right to:
- Request access to the information.
- Request correction of the information.

The Company’s Compliance Department will:
- Investigate your complaint.
- Contact you within two (2) business days of receiving the complaint.
- Work with you to resolve the matter.
